Renewal of the foreigner's residence

Important information for entrepreneurs

To renew your residence in Slovakia for the purpose of business, we draw your attention to an important legal requirement that must be met. Pursuant to Article 34(7) of the Act on the Residence of Aliens a third-country national required to submit an application pursuant to Section 22(1)(b) demonstrate:

• profit after tax of the company or cooperative on whose behalf it acts, at least 60 times the minimum subsistence level for the previous tax period,
• profit after tax in the case of a sole trader at least 20 times the minimum subsistence level for the previous tax period,

If the foreigner is acting on behalf of several companies or cooperatives, the condition of the amount of profit must be met by at least one of them.

This obligation is legally necessary in order for the application to be successfully assessed. As part of our services, we also assist clients with the correct interpretation of this requirement and with the preparation of the necessary documents.

Attention to the restriction on the possibility of reapplication

On the basis of amendments to the Act on the Residence of Alienswhich entered into force in 2024, a new restriction applies to all applicants for the renewal of temporary residence:

An alien may apply only once:

• 131k Transitional provisions related to the emergency situation in connection with the mass influx of foreigners to the territory of the Slovak Republic caused by the armed conflict on the territory of Ukraine

The validity of the temporary stay, which would otherwise be extended until the expiry of two months after the revocation of the emergency, does not apply in the case of, if the third-country national's application for renewal of residence has been refused

If the application is Rejected, it is not possible to resubmit a new application. The only way to stay in the Slovak Republic in such a case is to apply to change your purpose of residence - for example, to work (if the legal conditions are met).

This change fundamentally alters the situation for all foreigners who were previously able to submit a new application after being refused. From now on, it is necessary to prepare all supporting documents thoroughly and without errors at the first administration. General application documents

In order to renew a temporary residence pursuant to Act No. 404/2011 Coll. on the residence of foreigners, it is necessary to submit several documents. The specific requirements may vary depending on the purpose of the stay (employment, business, family reunification, studies, etc.), but in general the following basic documents apply:

Basic documents for the acceptance of the application:

1. Valid travel document (passport)
   • It must be valid for at least the entire duration of the requested stay.
2. Completed application
   • It is filed in person at the Aliens Police.
3. Proof of purpose of stay
   • It depends on the specific purpose:
     • Employment: an employment contract for the next period of stay with the approval of the Office of Labour, Social Affairs and Family,
     • Business: after-tax profit for the previous taxable year (previous calendar year) of 20 times the minimum subsistence level for a trade or 60 times the minimum subsistence level for a company
     • Study: confirmation of continuation of studies for the upcoming school or academic year
     • Family reunion: the family commitment must continue

4. Proof of financial security for your stay
   • A statement from a bank account in the name of the third-country national in the amount of at least 12 times the minimum subsistence level, except in the case of family reunification where a family member is the guarantor of the residence.
5. Proof of health insurance
   • A certificate of health insurance that is still valid and there are no outstanding health insurance arrears against the applicant. Does not apply, in the case of a temporary residence for business - managing director of a commercial company, such an applicant proves commercial health insurance.
6. Proof of accommodation
   • Rental agreement, confirmation from the landlord or proof of ownership of the property.
