Temporary stay for family reunification
The Slovak Republic authorises a foreigner (third-country national) to reside in the territory of Slovakia on the basis of a relationship with a family member (foreigner) who has already been granted temporary or permanent residence in the Slovak Republic. For temporary residence for the purpose of family reunification a third-country national with a Slovak citizen must apply for permanent residence for five years for the purpose of family reunification. This guide provides basic information on the conditions, procedure and obligations related to obtaining and maintaining temporary residence for the purpose of family reunification. It is in no way intended as a detailed guide on how to obtain a residence permit. Each case is individual and requires a specific procedure and approach to the applicant's request.
Who can apply for temporary residence for family reunification?
Temporary residence for the purpose of family reunification may be applied for by family members of a foreigner who has a family member in the Slovak Republic:
- granted temporary residence for employment, business or other purposes,
- granted permanent residence.
Family members are:
- Spouse,
- a dependent child (own or adopted)
- parent of a dependent minor child residing in the Slovak Republic,
- other persons in specific cases, if the law allows it.
It is important to prove a genuine family relationship and the intention to live together in the Slovak Republic. The foreign police authorities scrutinise the authenticity of the family relationship in order to prevent marriages of convenience or other fraudulent practices.
Conditions for obtaining temporary residence
A foreigner who wants to apply for temporary residence for the purpose of doing business must meet the following conditions:- Prove a family relationship to a foreigner already residing in Slovakia (marriage certificate, birth certificate, etc.).
- Demonstrate financial security - the family member must have sufficient financial means to stay, alternatively, a family member who has already been granted residence in the Slovak Republic can be the sponsor of the stay. In this case, he/she shall prove sufficient financial resources for all family members.
- Prove your integrity - a criminal record extract from the applicant's home country and all countries where the applicant has lived for a long time, with the necessary legalisation. Does not apply to minor children.
- Provide proof of accommodation - This can be a lease, a title deed or the consent of the property owner. The accommodation should be identical to the residence of the person to whom the family members are being reunited.
- Proof of health insurance - by concluding a contract with a health insurance company in the Slovak Republic.
- Meet other conditions arising from the legislation of the Slovak Republic.

Application procedure
Applying for residence
The application is submitted in person at the Slovak embassy in the country of origin or at the department of the Aliens Police in Slovakia if the foreigner is already legally residing in Slovakia on the basis of a granted national visa type D. Such an application cannot be made on the basis of a power of attorney, i.e. on behalf of the applicant. A representative person may assist with the application, however, due to the fact that the applicant must submit to the taking of biometric data, i.e. fingerprints and facial images, when applying for residence.
A foreigner may apply for temporary residence for the purpose of doing business in the Slovak Republic only if he/she is lawfully residing on the basis of visa-free travel or has been granted a D national visa. If the applicant is staying in the territory of the Slovak Republic on the basis of a Schengen C visa, it is not possible to submit an application in Slovakia. In this case, you must submit your application to the embassy of the country of which you are a citizen or where you are allowed to reside.
The application for temporary residence is made on an official form. When submitting it, the foreigner is obliged to present a valid passport together with all the documents stipulated by law. If some of the supporting documents are missing, the embassy or police department will not accept the application. In this case, the foreigner will receive written information on which documents need to be completed in order for the application to be accepted.
Needed documents
- Completed application form - the official form is correctly and completely filled in "Application for temporary residence, ENG (221.0 kB), PDF".
- Valid passport - must be valid for at least the duration of the stay.
- Proof of family relationship - a properly legalised civil registry document (marriage or birth certificate).
- Certificate of financial security - bank statement, employment contract or confirmation of the agreed salary, in the case of a sponsor of a stay, for each person for whom the sponsor will guarantee the financial security of the stay.
- Criminal records - issued by the competent authorities of the applicant's home country and countries where the applicant has lived for a long time. Not required for minors.
- Proof of accommodation - lease agreement, title deed or confirmation from the property owner. The accommodation should be identical to the sponsor of the residence, i.e. the person with whom the family member is reunited.
- Health insurance - proof of health insurance valid in the Slovak Republic.
The foreigner proves his/her good character by a criminal record extract from the country of his/her nationality, as well as from countries where he/she has lived for more than 90 days in the last three years.
This document must not be older than 90 days, must be officially translated into Slovak and, if necessary, apostilled or superlegalized. The Slovak police may also require an extract from the Slovak criminal record.
To demonstrate family relationship when applying for temporary residence for the purpose of family reunification the applicant must submit originals or certified copies the following documents:
1. Marital relationship (if applying on the basis of marriage)
- Marriage certificate
- It must be officially translated into Slovak (if not in Slovak or Czech).
- If it was issued abroad, it may be necessary apostille or superlegalization by country of origin.
2. Parental relationship (if applied for child)
- Child's birth certificate
- It must be officially translated into Slovak.
- If it was issued abroad, apostille or superlegalisation may be required.
- Consent of the other parent (if only one parent lives in Slovakia)
- A notarised declaration from the other parent that he or she agrees to the child's residence in the Slovak Republic.
3. Other family relationships (e.g. care of a dependent child, dependants)
- Documents proving family ties (e.g. adoption, custody order).
All foreign documents shall be officially translated and often apostilled or superlegalized depending on the country of origin.
At temporary stay for the purpose of family reunification the financial security of the stay is proven primarily by income Guarantor (of a person already resident in Slovakia and to whom the family member joins).
Options for demonstrating financial security:
Income of guarantor (spouse, parent, etc.)
- Proof of income from your employer (e.g. employment contract, last months payslips, annual tax statement)
- If the guarantor is a self-employed person - confirmation of filing a tax return, bank statements or invoices
Guarantor's bank account statements
- A bank statement for the last three months may be required to prove sufficient funds, together with an official translation in the case of a foreign bank.
Financial security is assessed according to the minimum subsistence level, and the sponsor must prove that he or she has sufficient income to cover the costs for himself or herself and a family member. The current amount of the subsistence minimum varies, so it is a good idea to check the current amounts on the website of the Ministry of the Interior or the Aliens Police.
The accommodation must meet the requirements of Section 62 (f) of Act No. 355/2007 Coll. on the protection, promotion and development of public health and on amendments and supplements to certain acts and Section 8 (1) of Decree No. 259/2008 Coll. of the Ministry of Health of the Slovak Republic on the details of the requirements for the internal environment of buildings and on the minimum requirements for lower standard apartments and accommodation facilities. According to the above, the living area of a lower standard apartment must be at least 12 m2 per occupant and 6 m2 for each additional personwho lives in the household with him. The useful floor area of the lower standard flat must be at least 15 m2.
Proof of accommodation arrangements must show that the third-country national has accommodation arrangements for at least six months of the temporary stay; if he or she applies for a temporary stay of a shorter duration, he or she must show that accommodation arrangements have been made for the duration of the temporary stay. In the case of family reunification, the third-country national must prove the provision of shared accommodation with the third-country national with whom he/she is applying for family reunification.
Approval process
The police have a statutory period of 90 days to decide on the application. If necessary, it may ask for documentation to be completed, which may prolong the process.Granting and issuing a residence card
If the application is approved, upon arrival in Slovakia the foreigner must undergo a medical examination, register for health insurance and apply for a document at the territorial competent department of the Aliens Police, where he/she will be issued a residence card.Obligations after obtaining temporary residence
After being granted a temporary residence for the purpose of business, the foreigner has the following obligations:- regularly prove that you meet the conditions of residence (e.g. proof of health insurance)

- to renew your residence before its expiry
Renewal of temporary residence
Temporary residence for business purposes is usually granted for one to three years. This type of stay is granted for a maximum duration of the guarantor's stay. An extension can be applied for before it expires, at the earliest 6 months before the expiry date, by providing evidence that the business is still active and generating income.The most common reasons for refusing an application
